Active vs. Forensic Images in E-discovery — The Difference Could Mean Spoliation.
July 20th, 2011 | by Kelly TwiggerUnderstanding the difference between an active image of a hard drive vs. a forensic image is crucial in preservation and collection for e-discovery. With all of the advancements in technology and the expanding use of cloud computing, most organizations still allow, and even encourage, users to store information on their hard drives. That means that information contained on hard drives must be preserved for e-discovery purposes once custodians and types of ESI have been identified.
Something You Might Not Have Considered: Assessing E-Discovery in M&A Due Diligence
As the M&A market continues to heat up, companies need to have as part of their due diligence checklist an assessment of how the target has addressed e-discovery in their litigation. How and whether e-discovery has been dealt with not only will give you insight into the risks in the litigation (including risks of an expensive discovery fight), but may also provide information on how well legal works with IT, and vice-versa. How well they work together pre-closing may be a good indicator on how well they will work together post-closing when integrating the businesses.
